South Lake Tahoe Business License and Vacation Rental Permits: 900-Permit Cap, Waitlist From August 21, 2026

If you plan to rent a home in South Lake Tahoe for fewer than 30 consecutive days, the vacation home rental (VHR) permit is the rule that matters most. This guide covers the 900-permit residential cap and the waitlist, the eligibility and operating rules for VHR permits, the application and renewal process, and the state and city registrations a new business in the City of South Lake Tahoe usually needs.

Informational content only: This guide is not legal or tax advice. Rules and fees change, so confirm current requirements with the City of South Lake Tahoe and the agencies named below. For complex situations, consult a qualified attorney or CPA.

Do you need a VHR permit?

Yes, if you rent a property for fewer than 30 consecutive calendar days in the City of South Lake Tahoe. This is the core south lake tahoe ca vacation home rental permit requirement, and it applies whether you rent the entire home or operate a short-term rental for a single guest group at a time. The permit system is local, so a permit issued elsewhere does not carry over. This guide covers only the California city in El Dorado County.

What changed: the 150-foot buffer is gone, replaced by a 900-permit cap

Earlier rules required a 150-foot buffer between VHRs, in force from June 17, 2025. Ordinance 2026-1203 took effect April 23, 2026, and replaced that buffer with a cap of no more than 900 VHR permits in residential areas. Do not plan around the 150-foot buffer, because it no longer applies.

A cap limits how many permits the City issues. It is not a ban on vacation rentals. Two areas are outside the cap and the waitlist: the Tourist Core and commercial zones.

The waitlist: August 21, 2026

The City's notice says that effective August 21, 2026, new VHR applications go on a waitlist as the City reaches the 900-permit cap. That date has now passed, so the waitlist can apply to you today. Whether your application is waitlisted depends on whether the cap has been reached when you apply.

If you are waitlisted, understand these limits:

  • Your application is not reviewed until a space opens.
  • The City does not estimate when a space will open.
  • A place on the waitlist does not guarantee a permit.
  • Permits are issued first come, first served as applicants finish the required steps.

Ask the VHR team at [email protected] whether the cap has been reached before you buy or commit to a property for rental use.

Who can get a permit

  • Single-family homes: Eligible, subject to the cap in residential areas and the rules below.
  • Attached condominiums: Eligible, unless the homeowners association prohibits rentals.
  • Other multifamily dwellings: VHRs remain prohibited.
  • Timeshares: Excluded from VHR regulation.

Check your HOA covenants before applying. An HOA prohibition can block a condominium permit even when the City would otherwise allow one.

Operating rules you must follow

  • Minimum renter age: 25.
  • Occupancy: Limited by the number of bedrooms and paved parking spaces. In homes with bedrooms, up to five children aged 13 and under are not counted toward occupancy.
  • Local property manager: Outside the Tourist Core, a local property manager must check in guests and respond to complaints. These requirements now apply in residential areas as well.
  • Records: Keep a record of every rented night for three years.
  • Transient occupancy tax (TOT): Applies to your rentals. Report room nights with each TOT payment. Confirm the current TOT rate with the City.

Inspections before you get a permit

In residential areas, you need two inspections before the permit is issued: a defensible space inspection and an on-site inspection. Plan for these early, since they come after the staff review in the process below.

The application process, step by step

  1. Submit the application through the City's online portal.
  2. Staff review: Staff has up to 30 days to tell you the next steps.
  3. Pay the application and inspection fee.
  4. Schedule and pass the inspection.
  5. Pay the occupancy or annual fee to complete the permit.

Payments are accepted only through the online application portal, by card or e-check. Check with the City of South Lake Tahoe for current permit, inspection and TOT amounts. This guide does not list them because the City's published page does not state them, and third-party blog or vendor figures may be out of date.

Renewal, transfers and appeals

  • Renewal: Permits renew annually. Under City Code 3.50.400(B), renew within 30 days before expiration. The owner is responsible for renewing, so put the date on your calendar.
  • Transfers: A permit is not transferable, with one exception. It can be transferred into a family trust where the owner is trustee.
  • Denials and revocations: You appeal to an independent hearing officer, not the Planning Commission.

Do you need a business license in South Lake Tahoe?

California has no general statewide business license. The Secretary of State issues no licenses or permits, and the CDTFA seller's permit is not a business license. Most businesses in South Lake Tahoe still need several registrations, and a short-term rental operator is a business too. Work through these steps in order.

  1. Form your entity with the Secretary of State. Use the bizfile Online portal. Articles of Organization (Form LLC-1) cost $70. Articles of Incorporation cost $100. Nonprofit articles cost $30. Online filings are normally processed within about 5 business days or less, and paper filings take 10 or more business days. Expedited options are 24-hour $350, same-day $750 (received by 9:30 a.m.), and 4-hour $500 (drop-off only, precleared).
  2. Register with the CDTFA if you sell taxable goods. The seller's permit is free. The statewide sales tax rate is 7.25%, and South Lake Tahoe's combined rate is 8.75%. See the CDTFA website.
  3. Register with the EDD if you have employees. The state minimum wage is $16.90 in 2026 and $17.40 from January 1, 2027, according to a secondary source, so verify it with the state before setting pay.
  4. Ask the City about a local business tax. Most California cities charge a local business tax or registration certificate (445 of 483 cities report revenue from one), and there is no common formula. Ask the City of South Lake Tahoe whether a general business tax applies to your activity and check the amount with the City. Counties license only regulated activities.
  5. Get a planning and building review. A new business, or a business moving to a new location, starts with the City's planning questionnaire and building questionnaire. A home-based business applies for a home occupation permit through the Planning Division.
  6. Check state licensing if your trade is regulated. Contractors need a Contractors State License Board license, and the contractor license threshold is $1,000. Other regulated professions are licensed by Department of Consumer Affairs boards.

Entity costs and deadlines to plan for

  • LLC franchise tax: Every LLC organized or registered in California in 2024 through 2026 owes the $800 minimum annual franchise tax from its first year. An LLC whose first taxable year begins in 2027, 2028 or 2029 pays $400 in year one under RTC 17941(g)(2), so confirm the first-year amount with the Franchise Tax Board. A newly incorporated or qualified corporation or S corporation owes no $800 in its first taxable year.
  • LLC fee: $900, $2,500, $6,000 or $11,790, depending on California-source total income of $250,000, $500,000, $1,000,000 or $5,000,000 or more.
  • Statement of Information: An LLC files Form LLC-12 for $20 within 90 days of filing its articles, then every two years in the six-month window ending on the last day of its anniversary month. A corporation files Form SI-550 for $25 within 90 days, then every year. Missing the LLC filing can trigger a $250 penalty.
  • Name reservation: $10 for 60 days. The reservation is not renewable for consecutive periods.
  • Registered agent: A California LLC or corporation must have an agent for service of process who resides in California, or a corporation that holds a Corporations Code 1505 certificate. An LLC must also keep an office in California.
  • Entity limits: California does not allow a domestic series LLC, and an LLC cannot render a licensed professional service. Professional corporations are used for that work.

Fictitious business name (DBA)

If you rent under a name other than your legal name, file a Fictitious Business Name Statement with the El Dorado County Clerk-Recorder within 40 days of starting. Publish it in a newspaper once a week for four weeks, and renew it every five years, since it expires after that. The statutory fee is $10 plus $2 per additional name or owner under Bus. & Prof. Code 17929, but counties charge more and the newspaper publication fee is separate. Confirm the county amount with the Clerk-Recorder. Details are at the Secretary of State's fictitious business names page.

Next steps

  1. Confirm whether your property is in the Tourist Core, a commercial zone or a residential area, because the cap and waitlist apply only to residential areas.
  2. Check your HOA rules and, if you own a condominium, confirm the rental is not prohibited.
  3. Email [email protected] to ask whether the 900-permit cap has been reached.
  4. Register your entity, name and tax accounts, then ask the City about its general business tax and your planning and building questionnaires.
  5. Ask the California Small Business Development Center network for free or low-cost planning help.
